Defining Contested Divorce
A contested divorce is one in which the parties do not agree to all of the terms of separation. A person who does not want a divorce can be said to contest the divorce.
When One Party Does Not Want To Divorce
Even if your spouse does not want the divorce, he or she cannot force you to stay married. Your testimony to the Court that the marriage cannot be repaired and that you will not reconcile with your spouse is sufficient. Your spouse cannot block your divorce action .
